Darrois Villey Maillot Brochier advised Sodiaal Group and its subsidiary Yéo Frais before the Paris Court of Appeal in the context of the fresh dairy products sector cartel
Darrois Villey Maillot Brochier advised Yéo Frais, 3A Groupe and Sodiaal Union before the Paris Court of Appeal in an appeal against the French Competition Authority decision N°15-D-03 of 11 March 2015 concerning anticompetitive practices in the fresh dairy products sector.
The French Competition Authority condemned Yéo Frais, 3A Groupe and Sodiaal Union to a € 12 million fine, due to Yéo Frais’ involvement in a cartel in the fresh dairy products sector.
By a ruling dated 23 May 2017, the Paris Court of appeal significantly reduced the amount of the fines imposed on fresh dairy producers.
In particular, the Paris Court of Appel held that the French Competition Authority infringed the legal requirement of individualization, as it did not take into account the fact that Yéo Frais was engaged in the cartel less than the other producers.
As a result, Sodiaal Group obtained a 35% reduction of its fine, which therefore decreased from € 12 million to € 7.7 million, i.e. – € 4.3 million.
